Terms of Service — E Weather

These Terms of Service ("Terms") form a binding agreement between you and E Weather ("we", "us", "our") governing your access to and use of the E Weather mobile application and any related services (together, the "App"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) to use the App. If you use the App on behalf of an organization, you represent that you are authorized to accept these Terms on its behalf.

2. License to use the App

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on a device that you own or control, for your personal, non-commercial use. This license does not transfer any ownership rights to you.

3. Acceptable use

You agree not to:

copy, modify, distribute, sell, lease, or create derivative works of the App;
reverse engineer, decompile, or attempt to extract the source code of the App, except to the extent this restriction is prohibited by applicable law;
access the App or its underlying APIs through automated means, or in a manner that imposes an unreasonable load on our infrastructure, circumvents rate limits, or attempts to scrape or bulk-extract data;
use the App to build or train a competing product or service;
interfere with or disrupt the integrity or performance of the App, or attempt to gain unauthorized access to it or related systems;
use the App in violation of any applicable law or regulation, or in any way that infringes the rights of others.

4. Weather data and forecast disclaimer

The App provides weather information — including current conditions, hourly and multi-day forecasts, indices, and astronomical data — sourced from third-party providers and computed models. This information is provided for general informational purposes only.

Weather forecasts are inherently uncertain and may be inaccurate, incomplete, delayed, or unavailable.
You must not rely on the App as the sole basis for decisions where inaccurate or untimely weather information could lead to injury, loss of life, or damage to property — including but not limited to aviation, marine navigation, mountaineering, construction, agriculture, or responding to severe-weather emergencies.
For safety-critical decisions, always consult official sources such as your national meteorological or hydrological service and local authorities, and follow their warnings.

5. Third-party services and content

The App relies on third-party services, including weather data providers (such as Open-Meteo, OpenWeatherMap, and WeatherAPI), geocoding based on OpenStreetMap data, Google Firebase, Google AdMob, and app distribution platforms. Your use of the App may be subject to those parties' terms and policies. We are not responsible for third-party services or content and do not endorse them.

6. Advertising

The App may display advertising (currently on iOS) to support its continued development and free availability. You acknowledge that ads may be served by third parties and that we do not control, and are not responsible for, advertiser content or the products and services advertised. Handling of advertising identifiers is described in our Privacy Policy.

7. Changes to the App

We may add, modify, suspend, or discontinue features of the App, in whole or in part, at any time and without liability. We may also release updates that you must install to keep using the App. Some features may depend on network connectivity or third-party availability and may not always function.

8. Intellectual property

The App, including its software, design, text, graphics, logos, and the "E Weather" name, is owned by us or our licensors and is protected by intellectual-property laws. Except for the license granted in Section 2, no rights are granted to you. Underlying weather data remains the property of its respective providers.

9. Privacy

Our collection and use of information is described in the Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to those practices.

10. Disclaimer of warranties

The App is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory. To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, title, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, timely, secure, error-free, or that weather information will be accurate or reliable.

11. Limitation of liability

To the maximum extent permitted by law, we and our suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of, or inability to use, the App — even if we have been advised of the possibility of such damages.

To the extent liability cannot be excluded, our total aggregate liability arising out of or relating to the App and these Terms is limited to the greater of (a) the amount you paid us for the App in the twelve months before the claim, or (b) USD 20.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability for fraud, gross negligence, willful misconduct, death or personal injury caused by negligence, or any other liability that cannot be limited by law.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the App or your violation of these Terms or applicable law.

13. Termination

These Terms remain in effect while you use the App. You may stop using the App and uninstall it at any time. We may suspend or terminate your access to the App if you breach these Terms or if we discontinue the App. Sections that by their nature should survive termination (including Sections 4, 8, 10, 11, 12, and 15) will survive.

14. Governing law and disputes

These Terms are governed by the laws of Vietnam, without regard to its conflict-of-laws rules. Subject to any mandatory consumer-protection rights available to you in your country of residence, the courts of Vietnam will have jurisdiction over any dispute arising out of or relating to these Terms or the App. Where required by local law, mandatory provisions of the law of your country of residence continue to apply.

15. General terms

Entire agreement: these Terms and the Privacy Policy are the entire agreement between you and us regarding the App.
Severability: if any provision is held unenforceable, the remaining provisions stay in full effect.
No waiver: our failure to enforce any provision is not a waiver of it.
Assignment: you may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
Changes to these Terms: we may update these Terms from time to time. Material changes will be reflected by an updated "Effective date" and, where appropriate, in-App notice. Continued use after changes take effect constitutes acceptance.

16. Apple App Store additional terms

If you obtained the App from the Apple App Store: these Terms are between you and us only, not Apple, and Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the App, including product-liability, regulatory, or intellectual-property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
